Avoqs – Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you (“Customer”) and Avoqs, a Sri Lankan apparel company engaged in the design, production, distribution, and sale of clothing, accessories, and related fashion products ("Company"). By accessing or using the website https://www.avoqs.com ("Website"), or by purchasing products, subscribing to newsletters, or using related services, you agree to comply with these Terms in full. These Terms apply to all transactions, including domestic and international purchases, delivery, returns, and digital interactions. If you do not agree with these Terms, you must refrain from using the Website or making purchases. Any prior agreements or communications are hereby superseded by these Terms.

1. Definitions

1.1 "Avoqs" refers to the Company operating under Sri Lankan law, specializing in the design and sale of clothing, apparel, accessories, and lifestyle products. "Company" and "Avoqs" are used interchangeably.

1.2 "Customer" refers to any individual or entity purchasing products, browsing the Website, or engaging with services provided by Avoqs.

1.3 "Products" include, but are not limited to, apparel, footwear, accessories, or other lifestyle items available for purchase on the Website.

1.4 "Website" encompasses https://www.avoqs.com and all associated pages including Shop, Blog, Account, Cart, and Checkout.

1.5 "Services" include order processing, delivery, promotions, newsletters, customer support, and related interactions offered by Avoqs.

2. Eligibility

2.1 Customers must be at least eighteen (18) years old or of legal contracting age in their jurisdiction to make purchases.

2.2 If purchasing on behalf of an organization, the Customer warrants they are authorized to bind the entity.

2.3 Unauthorized users, including minors, must refrain from engaging in transactions.

3. Product Information

3.1 Avoqs strives to ensure accurate descriptions, images, sizes, and prices. However, minor variations may occur due to photography, screen settings, or supply adjustments.

3.2 The Company reserves the right to modify product details, discontinue items, or adjust availability without prior notice.

4. Orders and Acceptance

4.1 Placing an order constitutes an offer to purchase, subject to acceptance by Avoqs.

4.2 Order confirmation via email does not guarantee availability until dispatched.

4.3 Avoqs reserves the right to reject or cancel orders due to pricing errors, stock shortages, or suspected fraudulent activity.

5. Pricing and Payment

5.1 Prices are displayed in Sri Lankan Rupees (LKR) unless otherwise indicated.

5.2 Payment methods include credit/debit cards, bank transfers, and other methods listed at checkout.

5.3 Customers are responsible for any applicable taxes, duties, or bank charges.

6. Shipping and Delivery

6.1 Delivery times vary depending on location, availability, and courier service.

6.2 International deliveries may be subject to customs duties or import taxes, payable by the Customer.

6.3 Avoqs is not responsible for delays caused by customs, strikes, or unforeseen circumstances.

7. Returns and Exchanges

7.1 Customers may request returns or exchanges within seven (7) days of receiving the Product, provided items are unused, unwashed, and in original condition with tags attached.

7.2 Refunds will be processed to the original payment method, excluding shipping fees, subject to inspection.

7.3 Sale items, innerwear, and customized products are non-returnable.

8. Intellectual Property

8.1 All trademarks, logos, images, designs, and content on the Website are the property of Avoqs.

8.2 Unauthorized use, reproduction, or distribution is strictly prohibited.

9. Privacy Policy

9.1 Avoqs collects and processes customer data in accordance with its Privacy Policy.

9.2 By using the Website, Customers consent to such processing for order fulfillment, communication, and promotional purposes.

10. Limitation of Liability

10.1 Avoqs is not liable for indirect, incidental, or consequential damages arising from the use of its Website or Products.

10.2 Liability shall in no case exceed the value of the Product purchased.

11. Force Majeure

11.1 Avoqs shall not be held responsible for failure to fulfill obligations due to events beyond its reasonable control, including natural disasters, strikes, wars, pandemics, or supply disruptions.

12. Governing Law

12.1 These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka.

12.2 Disputes shall be subject to the exclusive jurisdiction of Sri Lankan courts.

13. Amendments

13.1 Avoqs reserves the right to amend these Terms at any time. Updates will be posted on the Website with revised effective dates.

13.2 Continued use of the Website after changes constitutes acceptance of updated Terms.
